We have failed to listen. Will the current borough manager and the entire assembly finally take Chilkat Indian Village’s opinion seriously and immediately collaborate to agree on a dock design (as requested two years ago)? We can’t continue to ignore chilkatforever.org. Assemblymembers can shout from the rooftops that this isn’t about a mine, however it’s essential we work with CIV to rebuild the Lutak Dock.
MARAD’s Section 106 findings of “no adverse effects” of the encapsulated Lutak Dock design have been determined “premature.” What does this mean? Funds for the Lutak Dock project cannot be released until Section 106 is finished (Phase I).
“The Advisory Council on Historic Preservation (ACHP) received a request from MARAD to review its finding of “no adverse effect” for the Lutak Dock Project. MARAD requested ACHP’s opinion citing a disagreement with the effect-finding from the Chilkat Indian Village (CIV, Klukwan). Upon review of the documentation provided, it appears that MARAD has not appropriately applied the criteria of adverse effect to the undertaking and that the finding is premature,” as detailed in ACHP’s recent response.
MARAD and the Chilkat Indian Village’s government-to-government consultations, a requirement to receive the RAISE grant under Section 106: National Historic Preservation Act of 1966, is not going away. We’ve wasted two years fighting about an encapsulated design that we knew we couldn’t afford (after the $10 million penalty if we used the steel), and that CIV would never be in agreement. Please act now.
