The plan to go underground was communicated to investors in 2016 but left out of that year’s permit application. This was pointed out during the application process with several requests that underground activities be included in the environmental analysis. All were denied.
Constantine could also mention that in June 2018 they received approval from Dept. of Natural Resources to begin construction on a system to dump 2,500 gallons a minute of wastewater directly into the ground near Glacier Creek. The required Reclamation Plan had a 20-day appeal window but its existence was not revealed by either Constantine or DNR until it was too late.
Constructing any part of a disposal system without approval from the Dept. of Environmental Conservation seems to violate 18 AAC 72.600(a) “[a] person who constructs, alters, installs, modifies, or operates any part of a non-domestic wastewater treatment works or disposal system must have written departmental approval of engineering plans submitted under this section” (emphasis added). DEC has not approved anything, but it would seem that some work has been done at the site.
The environmental information they are collecting also has not been revealed. There has been no environmental or hydrological information submitted to either agency or the public.
