The Haines Borough and resident Paul Nelson are once again locked in a dispute stemming from Nelson’s use of glass for fill on his Skyline Estates property.
The assembly last week agreed to hear Nelson’s appeal of a $1,200 penalty staff assessed after determining Nelson hadn’t met the deadline for removing the broken glass from his property.
The assembly in June ordered Nelson to remove and properly dispose of the fill surrounding his property within 10 days. He was also required to cap the foundation and pay a $300 fine.
According to a letter sent to Nelson by manager David Sosa on Feb. 10, borough staff inspected Nelson’s property on June 20, 21, and 22 and found while Nelson had made progress, he hadn’t completed the task in the required time period.
On June 26, staff found Nelson had completed the task. The borough assessed a $300 per day fine for the five days past deadline, totaling $1,500.
Nelson wrote a $300 check to the borough in July, but contends in his appeal that the borough, according to code, cannot fine people more than $300, and that the $1,200 remainder of the $1,500 penalty is invalid.
The assembly will hear Nelson’s appeal Tuesday.
