The land by the Haines Highway 18 mile marker holds a lot of personal history for Patrick Philpott.
He grew up gardening there on a plot his family has cultivated for generations, stretching back to the early 20th century, when they opened a roadhouse nearby.
The land is now part of the state Chilkat Bald Eagle Preserve. The 48,000 acre preserve was established in 1982 to protect large populations of bald eagles that fish there.
Philpott wants to re-establish that old family garden, and he argues that the preserve's language allows for that kind of use. But the state's Division of Parks disagrees and has denied his permit application to do so.
